1. Acceptance of Terms

By accessing or using Floof ("the App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

2. Description of Service

Floof is a social accountability app. Users form small groups ("tribes"), commit to a shared goal, and post photo proof that they showed up. A virtual companion ("floof") visualises your progress.

3. Eligibility

You must be at least 13 years old to use Floof. By creating an account you confirm you meet this requirement.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

6. Content Ownership & License

You retain ownership of content you post. By posting, you grant Floof a non-exclusive, worldwide license to host, store, display, and distribute your content within the App and its tribe feeds.

8. Subscriptions (Floof+)

Floof+ is an optional paid subscription ($3.99/month or $24.99/year). It is billed through Apple In-App Purchase on iOS and Google Play Billing on Android. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID or Google Play account settings.

Refunds are handled by the respective platform (Apple or Google), not by Floof.

9. Apple App Store Additional Terms

The following terms apply if you downloaded Floof from the Apple App Store.

9.1 Acknowledgement

These Terms are concluded between you and Floof Labs only, and not with Apple Inc. ("Apple"). Floof Labs, not Apple, is solely responsible for Floof and its content. These Terms may not provide for usage rules that are in conflict with, or that otherwise violate, the Apple Media Services Terms and Conditions as of the effective date of these Terms.

9.2 Scope of License

The licence granted to you for Floof is limited to a non-transferable licence to use Floof on any Apple-branded products that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that Floof may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

9.3 Maintenance and Support

Floof Labs is solely responsible for providing any maintenance and support services with respect to Floof. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Floof.

9.4 Warranty

Floof Labs is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Floof to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Floof (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Floof, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Floof Labs.

9.5 Product Claims

Floof Labs, not Apple, is responsible for addressing any claims by you or any third party relating to Floof or your possession and/or use of Floof, including but not limited to: (i) product liability claims; (ii) any claim that Floof fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

9.6 Intellectual Property Rights

In the event of any third-party claim that Floof or your possession and use of Floof infringes that third party's intellectual property rights, Floof Labs, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.

9.7 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9.9 Third Party Terms

You must comply with applicable third-party terms of agreement when using Floof (for example, your wireless data service agreement).

9.10 Third Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

10. Termination

We reserve the right to suspend or terminate your account for violations of these Terms.

11. Disclaimer

The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation, and Floof is not a substitute for professional advice (medical, psychological, financial, etc.).

12. Limitation of Liability

To the maximum extent permitted by law, Floof shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

13. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the new Terms.
